The Experiences and Perceptions of Sexually Abused Children as Participants in the Legal Process: Key Conclusions From a Scoping Literature Review

Child sexual abuse (CSA) is a phenomenon that receives attention from researchers and practitioners worldwide. An unknown percent of cases are disclosed bravely by children to authorities. One part of those children's journey can involve the legal process, which aims to decide whether a crime happened and, if so, to sentence the offender. To do so, a considerable amount of evidence is required. Part of what makes CSA cases complex is that the child's word is often the only evidence. There are growing discussions concerning the importance of children's participation in the legal process, pointing to its contribution to practitioners' decision-making as well as children's wellbeing. The current scoping review aimed to examine the existing knowledge regarding how children experience and perceive participation in the legal process following CSA. Although this issue has been previously addressed, the current study was designed to systematically spotlight studies that pinpoint children's perceptions and experiences. Using PRISMA guidelines, 17 manuscripts in peer-reviewed journals over the last 11 years were identified. The analysis yielded a major theme of children's need for validation, with four subthemes relating to the need to be protected, the need to be seen and heard, the need to be believed, and the need to be provided with support. The themes and how they relate to other aspects of sexually abused children's lives are discussed as well as practical implications for future studies. The main conclusion relates to the necessity for a holistic approach with children throughout the legal process.

"The most shocking thing was that I didn't respond to the abuse": The peritraumatic responses and transitions as conveyed by survivors of continuous child sexual abuse

BACKGROUND

Child sexual abuse (CSA) is a worldwide phenomenon with ongoing and far-reaching consequences for millions of children worldwide. It is a consensus among researchers that continuous CSA represents a unique challenge.

OBJECTIVE

The current study aimed to explore the peritraumatic responses of survivors of continuous CSA as described in their written narratives of abuse. The transitions between the peritraumatic responses will also be examined, highlighting the unique context of continuous CSA.

PARTICIPANTS AND SETTING

Written narratives of CSA were recruited via an advertisement in the media inviting CSA survivors to share their stories of abuse on an anonymous online platform. The data collection was carried out under the Israeli Independent Public Inquiry on CSA.

METHODS

A qualitative thematic analysis was applied to 32 richly written accounts of abuse.

RESULTS

Three peritraumatic responses were identified: the adaptive response, hinting, and attempts to fight and flight. Transitions between these responses were described by the survivors and addressed the heavy load of the abuse, realization of the abuse, fear of consequences and the central role of the survivor's environment.

CONCLUSIONS

The current study provides a unique platform for the exploration of peritraumatic responses in continuous CSA. Alongside the identification of three peritraumatic responses described by the survivors, the current study provides an initial glance into transitions between peritraumatic responses. This insight strengthens the developing notion that peritraumatic responses in the unique context of CSA are a top-down process, often shaped by various contexts and multidimensional dynamics in the children's lives.

Dyadic Reports Using the Parental Support after Child Sexual Abuse Measure: Psychometrics and Associations with Post-Traumatic Stress Disorder Symptoms

This study assessed the psychometric properties of a new measure, the Parental Support after Child Sexual Abuse (PSCSA) survey, and tested the association between parents' and children's parental support reports and children's post-traumatic stress disorder (PTSD) symptoms. A total of 99 Icelandic children (86.5% girls, 6-18 years old, M = 13.9 years) starting therapy for child sexual abuse (CSA) and 98 non-offending parents (90.6% mothers, 23-58 years old, M = 41.2 years) participated in the study. Participants completed questionnaires on parental support (PSCSA) and children's PTSD symptom severity (University of California at Los Angeles Post-Traumatic Stress Disorder Reaction Index for the Diagnostic and Statistical Manual of Mental Disorders, fourth edition). A total of 18 items were considered for the PSCSA parent version and nine for the PSCSA child version. Five reliable factors emerged for the parent version (Emotional support, Instrumental support, Self-blame, Child blame and Disbelief) using 16 items and one factor (combined Emotional and instrumental support) emerged for the child's version using eight items. On average, ratings for both Emotional and Instrumental support were higher for parents than their children. Emotional support reported by both parents and children was negatively associated with PTSD symptom severity. The PSCSA survey is a promising dyadic measure for future research and clinical use in children's advocacy centres.

Gendered Attributions of Blame and Failure to Protect in Child Welfare Responses to Sexual Abuse: A Feminist Critical Discourse Analysis

Gender-based relations of power and attributions of blame for child sexual abuse have been longstanding in child welfare policy and practice. Nonoffending mothers continue to be ascribed responsibility through the ideologically and institutionally entrenched doctrine of failure to protect. Feminist critical discourse analysis was used to (a) expose and disrupt dominant discourses of gender, motherhood, and risk that operate to construct and reinforce notions of blame and failure to protect, as enacted by way of child welfare text in context; and (b) build a credible case for social and organizational change grounded in an alternative discourse with greater explanatory power. Progressive avenues for resistance, negotiation, and transformation are proposed.
