Explaining Male Sex Offender Recidivism: Accounting for Differences in Correctional Supervision

PURPOSE

Contrary to public opinion, empirical studies have consistently shown that persons convicted of a sexual offense (PCSO) are less likely to recidivate with a general offense. While researchers often point toward the surreptitiousness of sexual offending to explain low rates of recidivism, this paper tests a novel explanation: SOs recidivate at lower rates than persons convicted of a non-sexual offense (PCNSO) because they are more often revoked to prison before they are able to commit a new crime, perhaps owing to more restrictive post-release supervision guidelines.

METHODS

Using a sample of 196,468 unique male releases, the difference in general and sexual recidivism between PCSO (n = 29,420) and PCNSO was assessed through survival analyses (Cox regression models).

RESULTS

Results demonstrated that PCSO were significantly less likely to be reconvicted for a general crime, but more likely for a sex offense. They were also more likely to be reincarcerated due to a revocation without a new sentence. Accounting for revocations, the difference in reconviction risk lessens between the groups but does not disappear.

CONCLUSIONS

This analysis provides evidence that differences in community supervision are contributing to the difference in recidivism rates between PCSO and PCNSO. Implications and future research are discussed.

The crime of luring a minor for contact sexual abuse: Exploration of demographic patterns & criminal records of convicted offenders

BACKGROUND

Child sexual abuse (CSA) is a significant public health problem, with a small but important subset of crimes committed by strangers, often facilitated through luring. Understanding the characteristics of individuals who engage in luring is essential for developing effective prevention and intervention strategies.

OBJECTIVE

This study aimed to analyze the demographic characteristics and criminal histories of individuals convicted of luring a minor and to examine the types of crimes committed before and after conviction.

PARTICIPANTS AND SETTING

The study included all individuals (N = 115) convicted of "luring a minor" between 2011 and 2021 in one county in Oregon.

METHODS

The study used demographic data and frequencies to provide an overview of who is being convicted of luring and what other crimes they have committed prior and after their conviction.

RESULTS

Most were male (97.39 %), White (70.43 %), and the average age at first arrest was 33.06 years. Before conviction, 35.65 % had prior arrests, with assault (34.15 %) and probation violations (24.39 %) being most common. After conviction, 98.26 % were rearrested, with luring (60.34 %) and online sexual corruption (41.38 %) being the most frequent charges. Crimes against children were the most prevalent type of crime.

CONCLUSIONS

This study provides valuable insights into the characteristics and criminal histories of individuals convicted of luring minors. The high prevalence of child-related crimes after conviction, including progression to commercial sexual exploitation and child sex trafficking, underscores the need for comprehensive interventions, robust monitoring, and ongoing community education to prevent further harm to children. Future research should replicate this study across different jurisdictions to identify regional differences, examine the relationship between jurisdictional definitions and crime patterns, and evaluate the effectiveness of various supervision and monitoring strategies in reducing recidivism among those convicted of luring.

A New Identity: Enhancing Life Skills and Work-Readiness for Those With a Sexual Offending History

The purpose of this research was to examine the experiences of individuals, with a sexual offending history, who have engaged with a community-based life skills and work-readiness programme. With a view to understand the impact of such programmes on their rehabilitation and to inform a growing body of research around the approaches needed for promoting rehabilitation within this group. Semi-structured interviews were conducted with four participants about their experiences of accessing a community-based charity and three themes were identified using Interpretive Phenomenological Analysis: "a place to belong without fear or judgement;" "creating an identity away from offending;" and "space and time to realise own potential." These findings were discussed in relation to the Good Lives Model; previously identified protective factors for people with a history of sexual offending; and desistance research. The research offers a number of recommendations for practice which can be used by organisations to help them develop an inclusive and meaningful approach to supporting individuals with a history of sexual offending.

Explaining the Unexplainable: Balancing Responsibility, Expectations, and Identity in Narratives of Sexual Recidivism

When someone is caught and punished for a sexual offense, recidivism prevention is of high priority. While a growing body of qualitative research has investigated the desistance process of those who have sexually offended, few studies have examined the narratives of individuals who have sexually recidivated in order to understand how they make sense of their reoffending. This study aims to fill this gap in the literature by exploring the recidivism process and broader life stories of 16 imprisoned men through semi-structured interviews. The results demonstrate how these men explain their recent "failures," the obstacles they face when doing so, and how they attempt to overcome these obstacles in their narratives. Thus, the analysis in this study is both thematic and narrative. Finally, the findings' practical implications are discussed to show how ambiguity in narratives can be a powerful tool in correctional and clinical interventions.

Cardinal Principles to Consider: The Rationale for Implementing Therapeutic Jurisprudence with Youth Manifesting Sexually Abusive Behaviors

This article brings attention to cardinal principles to consider when implementing the Therapeutic Jurisprudence multidisciplinary approach with youth who are manifesting sustained coarse sexual improprieties and come to the attention of the judicial system. The obstacles of implementing therapeutic jurisprudence with this population include the persistent reliance of researchers on adult paradigms for risk assessment tools, along with treatment models that are not developmentally and gender sensitive, nor empirically supported for youth. Adherence to the scientific method is essential when constructing risk assessment tools that meet forensic standards. Applying the rich collateral paradigm of therapeutic jurisprudence within the context of valid and reliable measurements of intervention outcomes would immensely benefit those youth entangled with judicial systems who repeatedly are victims of abuse (neglect, maltreatment, physical and/or sexual). Youth who become entangled with the judicial system as dependents, and/or suspected or charged with criminal activity, need additional collateral resources geared toward ongoing developmental needs and specific to gender. Practical considerations and recommendations are made in contemplating expanding Therapeutic Jurisprudence with youth who engage in sustained sexually harmful behaviors to self and others.

Dealing With Rape Cases in Ghana: The Law, the Victim and the Offender

Rape is a criminal offence in all countries of the world. However, what constitutes rape in the legal sense differs from country to country, with many common law countries sharing some similarities in their definition of rape. This paper conducts a critical review of the crime of rape in Ghana by discussing what constitutes rape under Ghanaian law, its key elements which a prosecution has to prove to succeed on a charge of rape, and the challenges of adjudicating rape cases in Ghana, paying particular attention to the victim. Furthermore, the manuscript offers some useful recommendations on improving current practice. Among the challenges identified as militating against the successful prosecution of rape cases in Ghana are the high poverty level resulting in the lack of money to pay for the costs of forensic medical examination by the victim, stigmatisation and ridicule of rape victims, lack of social and psychological support for the victims of rape, the unduly long period adjudication of rape cases take, the gender-specific definition of rape, and the general inadequate or lack of reformative services for rape prisoners. The paper recommends that the state of Ghana should take steps to tackle these challenges in order to promote justice for rape victims, while effectively dealing with the perpetrators of such crimes. These steps could include, the State covering the costs of forensic medical examination for rape victims through the National Health Insurance Scheme, intensifying public education on rape and its consequences, especially on the victim, and amending the definition of rape to make it gender-neutral instead of gender-specific. This paper will be useful to legal, psychological, and sociological researchers in Ghana and the world over.
