Multiple "Lower BAC" offenders: Characteristics and response to remedial interventions

BACKGROUND

In recent years, there has been increasing attention to "lower BAC" drinking drivers, typically those whose blood alcohol content (BAC) is under the legal limits defined in criminal law. In 2009, legislation was enacted in Ontario, Canada that enabled police to issue roadside license suspensions to individuals caught driving with BAC between 0.05% and 0.08%, known as the "warn range". Multiple warn range (MWR) offenders are required to attend the Back on Track (BOT) remedial measures program. This study aimed to provide: (1) a preliminary characterization of MWR drivers charged under warn range legislation; and (2) an initial assessment of outcomes associated with BOT participation among MWR offenders.

METHODS

A subsample of 727 MWR offenders was drawn from program records, and compared to samples of 3597 first-time Criminal Code (CC) offenders (those caught driving with a BAC of 0.08% or higher) and 359 second-time CC offenders. To provide an initial assessment of outcomes associated with BOT participation, another subsample consisted of 394 MWR participants from whom pre- and post-workshop questionnaires were collected and successfully matched using probabilistic matching processes.

RESULTS

Similarities in demographic profile and driving history between MWR and first-time CC participants were apparent. MWR offenders scored higher on risk of problem drinking and drink-driving recidivism than either of the CC offender groups. Second-time CC offenders scored higher on these measures than first-time CC offenders. Following BOT participation, MWR participants demonstrated positive change including improved knowledge of and intentions to avoid drink-driving.

CONCLUSIONS

MWR offenders share a similar demographic profile to that of first-time CC offenders and they report significantly higher risk of problem drinking and recidivism. MWR offenders may include high-functioning problem drinkers who are likely to continue drink-driving and who may escalate to a CC drink-driving offense. Like CC offenders, MWR offenders benefited from BOT participation.

Posts to online news message boards and public discourse surrounding DUI enforcement

OBJECTIVE

This study analyzes posts to online news message boards covering driving under the influence (DUI) enforcement efforts to determine their usefulness for informing traffic safety program planning and public relations efforts aimed at mainstream drinking drivers.

METHODS

A series of Google searches were conducted using keywords designed to capture news stories regarding impaired driving enforcement efforts. For each search, the first 100 Web pages returned were reviewed and articles were included in analysis if they were from an independent news source and contained user comments. Coders captured data on 28 fields for each post, including tone in relation to enforcement, tone of interpersonal communication with other posters, and expressed feelings regarding drinking and driving.

RESULTS

Fifty-six news articles covering DUI enforcement efforts met study criteria, with 615 posts. The majority of posts (57%) were neutral on DUI enforcement; 24 percent (148) took a negative tone and 19 percent (115) positive. Posts that discussed checkpoints were 2.6 times more likely to take a negative tone toward enforcement than those that did not. Twenty-one percent of anti-enforcement posts challenged the idea that driving after drinking was necessarily dangerous. Of the 321 posts involving direct communication between posters, 67 percent involved disagreement with another post. Profanity or belittling comments appeared in 10 percent of posts.

CONCLUSION

Public responses to DUI enforcement news articles provide insight into the beliefs and thought processes of those who oppose enforcement efforts or view drinking and driving as no big deal. Primary objections to enforcement focused on civil and personal rights issues, skepticism regarding law enforcement's motives and objectivity, and the belief that drinking driving is not a "real" crime. Online news message boards could be useful in informing campaigns and helping program planners frame media events and press releases to best appeal to the most at-risk segments of the driving public.

Hardcore drinking drivers and other contributors to the alcohol-impaired driving problem: need for a comprehensive approach

Understanding the hardcore drinking driver concept in the context of the alcohol-impaired driving problem.

METHOD

Review of the relevant literature.

RESULTS

As progress against alcohol-impaired driving slowed in the early 1990s, public and political attention turned to "hardcore" drinking drivers, and they have been a priority for the past 15 years. Though intuitive, the hardcore concept has been difficult to conceptualize. Its definition of hard-to-change chronic heavy drinking drivers focuses on a group that is not easily identifiable and ignores many who account for a large portion of alcohol-impaired driving crashes. These include drivers who drink heavily on occasion and drivers who drink at more moderate levels that elevate crash risk. Emphasis on the hardcore has focused attention on the small proportion of drinking drivers who have been detected and arrested, whereas the vast majority of drinking drivers go undetected. Some countermeasures aimed at the hardcore group have been effective in reducing recidivism, but attention and resources also need to be given to general deterrent initiatives (e.g., 0.08 g/dL, sobriety checkpoints, administrative license suspension). There has been no reduction in the overall alcohol-impaired driving problem since the mid-1990s.

CONCLUSION

Reductions in the alcohol-impaired driving problem require that attention be focused on all relevant target groups. Some benefits could accrue by recognizing that countermeasures developed for hardcore drinking drivers, such as alcohol ignition interlocks and vehicle or plate impoundment, might also be effective with more numerous first-time offenders. However, such strategies are likely to be most effective against recidivism (specific deterrence). Greater gains could be achieved through general deterrent efforts (increasing the real and perceived risk of arrest and punishment to all drinking drivers), along with application of public health measures designed to reduce overall consumption. Additional ways need to be found to separate drinking and driving, either through cultural changes in drinking and/or driving behavior or, in the future, with the use of technology that can make vehicles inoperable by drivers with illegal blood alcohol concentrations.
