Credibility assessment in child sexual abuse investigations: A descriptive analysis

When an alleged victim has a pre-existing psychopathological diagnosis, this can affect the rating of their version of the abuse in terms of credibility. The objective of this work is to analyze the relationship between the assessment of the credibility of the testimony of a CSA victim, the psychological problems that the child may have presented prior to sexual abuse and the possible psychological sequelae that she may present as a result of the abuse. 109 cases were selected in which the credibility of the testimony could be determined. Through forensic interviews and the study of the corresponding professional reports, the following were obtained: sociodemographic data, data on their previous psychological state and data on their psychological state after the reported events. The psychological state of the child after the reported events shows no relation to the forensic evaluation of the credibility of her testimony. The existence of a relationship between the absence of previous psychopathology and the fact that the victim's testimony is valued as a credible account is confirmed. This study reveals that children who presented psychological manifestations prior to their experience of abuse receive a lower credibility rating than those without previous psychopathological symptoms or diagnoses.

Forensic Interview Techniques in Child Sexual Abuse Cases: A Scoping Review

Child sexual abuse (CSA) is widely recognized as a global public health problem with negative consequences for victims, their families, and society. The child's testimony is essential to the case outcome, given the frequent absence of physical or biological evidence of the abusive acts. Thus, the child forensic interview plays a decisive role in criminal investigation. The present scoping review aims to identify and describe the judicial procedures for collecting CSA victims' testimony using an evidence-based approach and a structured methodology. The review followed Preferred Reporting Items of Systematic Reviews and Meta-Analysis-Scoping Review guidelines. Studies were identified through manual reference checking and in four electronic databases: PsycARTICLES, PubMed, SCOPUS, and Web of Science. In all, 146 studies were identified according to the defined inclusion criteria, that is, empirical studies identifying judicial procedures to collect CSA victims' testimony, published in English or Portuguese. In total, 30 different forensic interview procedures to collect the child victim's testimony were found. The National Institute for Child Health and Human Development investigative interview protocol was the most frequently mentioned. Despite the variety of protocols, it was possible to conclude that they have a similar general structure. This review also identified gaps in interviewing practices with CSA victims. The scoping review corroborates the importance of forensic interviews with CSA victims, stating its implications for criminal investigation, the legal system, and the child's recovery process.

Perceptions of Allegations of Repeated Victimization: The Roles of Event Frequency, Language Specificity, and Disclosure Delay

Although many forms of victimization are repeated (e.g., domestic violence), we know relatively little about the perceived credibility of adult claimants who allege repeated maltreatment. We examined the effects of Event Frequency (Single vs. Repeated), Language Specificity (Episodic vs. Generic), and Disclosure Delay (Immediate vs. Delayed) on laypersons' perceptions of claimant credibility. Participants (N = 649) read a mock interview transcript and provided subjective ratings (e.g., credibility, likelihood of suspect guilt, claimant responsibility). When the alleged abuse occurred a single time (vs. repeatedly), participants rated the interviewee as less blameworthy but no more (or less) credible. Exploratory findings indicated that female participants viewed the interviewee as more credible and less responsible than did male participants.

Atitudes e tomada de decisão de profissionais na avaliação de situações de abuso sexual

O objetivo deste trabalho foi caracterizar as atitudes dos profissionais que atuam na rede de proteção em relação à avaliação de casos de abuso sexual (AS) e investigar relações com os níveis de autoeficácia ocupacional, tomada de decisão, características sociodemográficas e laborais. Participaram do estudo 165 trabalhadores, 86% do sexo feminino, com idade média de 37,6 anos (DP = 10,1 anos). A análise de rede apontou que a atitude denominada especificidade regula as atitudes de sensibilidade e ceticismo. A autoeficácia ocupacional não se relacionou com nenhuma variável e a tomada decisão apresentou correlação negativa com a atitude sensibilidade. A idade apresentou correlação negativa com a atitude sensibilidade. Profissionais que atuaram na área jurídica apresentaram maiores níveis de medo de não identificar o abuso em comparação aos profissionais da Saúde. Os resultados indicam a necessidade de investimento em treinamentos efetivos para adoção de práticas baseadas em evidências em para atuação nos diferentes setores da rede de proteção e atendimento, bem como importância de supervisão de casos para adequada identificação, notificação e encaminhamentos.

Predicting disclosure latency in substantiated cases of child sexual abuse

OBJECTIVE

Children who experience sexual abuse (CSA) often delay disclosure, thus impeding early interventions. This study explores predictors of disclosure latency in a sample of forensically substantiated cases.

METHODS

Court files were analyzed for a total of 124 cases of CSA. The ground truth of the alleged victims' statements had been substantiated by at least one inclusion criterion-an evaluation of the alleged victims' statement as credible by psychological experts applying Statement Validity Assessment (SVA), or the conviction of the suspected offender by the court. Six possible predictors of disclosure latency were tested individually and in a joint negative binomial regression model.

RESULTS

Younger age of the child at abuse onset and intrafamilial (vs. extrafamilial) child-perpetrator relationships (including stepparents) were associated with prolonged disclosure latency. No predictive evidence was found for the child's gender, severity of abuse, or offender's usage of violent or nonphysical strategies to prevent disclosure.

CONCLUSION

This study contributes to understanding the processes of disclosure by reassessing formerly identified predictors of disclosure latency in a sample of forensically substantiated cases. Results are in line with suggestions to further develop effective prevention programs for younger children (e.g., for elementary school) and to explicitly discuss the issue of intrafamilial abuse.

Avaliação do dano psíquico associado ao depoimento especial

O Depoimento Especial de crianças e adolescentes vítimas de violência sexual vem sendo realizado por psicólogos judiciários. O objetivo deste artigo é discutir um modelo de avaliação psicológica prévia ao depoimento, voltada à ocorrência de danos psíquicos ou revitimização a ele associados. Para tanto, apresenta-se síntese reflexiva da experiência profissional dos autores em processos criminais envolvendo violência contra crianças e adolescentes, debatida à luz da literatura especializada nas áreas da Avaliação Psicológica e Psicologia Forense. Na dimensão intrapsíquica do dano, sugere-se a avaliação de fantasias, ansiedades e mecanismos de defesa da criança associados ao depor. Na dimensão intersubjetiva, aprecia-se seu nível de desenvolvimento cognitivo, raciocínio moral e vinculação ao entrevistador. Observou-se a aplicabilidade das técnicas projetivas temáticas – CAT-A, TAT e Procedimento de Desenhos-Estórias – para avaliar tais constructos, utilizando-se vinhetas clínico-forenses para ilustrar o raciocínio avaliativo. Conclui-se que proteger a criança do processo penal é proteger o próprio processo penal.

Applying Hierarchy of Expert Performance (HEP) to investigative interview evaluation: strengths, challenges and future directions

The purpose of this paper is to systematically examine the research literature on the decision of expert interviewers within the theoretical framework of the Hierarchy of Expert Performance (HEP). After providing an overview of the HEP framework, existing research in the investigative interviewing at each of the eight levels of the HEP framework is reviewed. The results identify areas of strength in reliability between experts' observations (Level 2) and of weakness in reliability between experts' conclusions (Level 6). Biases in investigative interview experts' decision making is also revealed at biasability between expert conclusions (Level 8). Moreover, no published data are available in reliability within experts at the level of observations (Level 1) or conclusions (Level 5), biasability within or between expert observations (Level 3 and 4) and biasability within expert conclusions (Level 7). The findings highlight areas where future research and practical endeavour are much needed for the investigative interview.

Searching for Truth: The Forensic Interviewer's Use of an Assessment Approach While Conducting Child Sexual Abuse Interviews

This study examined the assessment approach interviewers use while conducting interviews to assess truth as narratives are gathered in children's disclosure statements by examining 100 forensic interviews completed at a Children's Advocacy Center. A descriptive review was used to examine the steps engaged by interviewers as they followed a protocol and content analysis was used to identify interviewers' questioning strategies as they assessed children's disclosure narratives during interviews. Findings indicate that interviewers apply a protocol in order to support advancing to a phase of eliciting details in children's narratives. Questioning strategies included using a variety of question types to progress from general to specific, incorporating interview aids sparingly as necessary, and integrating multidisciplinary team feedback. Findings suggest that an assessment approach is inherent to the process of actively conducting a forensic interview. Rather than assessment beginning strictly upon completion of children's narratives, this paper describes how interviewers incorporate an assessment framework throughout interviewing.

Knowledge, Attitude and Practice of Child Sexual Abuse Prevention among Parents of Children with Hearing Loss: A Pilot Study in Beijing and Hebei Province, China

This study aimed to examine the knowledge, attitude, and practice (KAP) of child sexual abuse (CSA) prevention among parents of children with hearing loss. The study involved 127 pairs of parents with deaf and hard of hearing children from three special education schools in Beijing and Hebei province, China. The findings revealed that the parents lacked knowledge about CSA prevention, such as the character of perpetrators and child victims. Parents were supportive about potential CSA prevention education in schools. Most parents told children much about personal safety, but topics on CSA prevention were still insufficient. The study also found that education level was significantly associated with knowledge and attitude. Elder parents knew more and talked more about CSA prevention. Mothers and girls' parents were more willing to communicate with children about CSA prevention. The conclusion of the study was that parents appeared to have gained a positive attitude, but poor knowledge and practice. Their knowledge and skills of effective communication should be strengthened to promote CSA prevention practice.

A meta-analysis of the prevalence of child sexual abuse disclosure in forensic settings

BACKGROUND

Identification, substantiation, prosecution, and treatment of child sexual abuse often rely heavily on a disclosure from the victim in the absence of corroborating evidence. For some, disclosure can be impeded by developmental or motivational barriers, thus compromising child safety and wellbeing. The literature on disclosure prevalence and mitigating influences does not yield a coherent picture. A more accurate estimate will help to inform investigation strategies to facilitate disclosure.

OBJECTIVE

This study provides a meta-analysis of available research examining the prevalence of sexual abuse disclosure in forensic interviews with children under 18 years, and examines a range of factors that may influence the likelihood of disclosure.

METHOD

Databases were searched for published and unpublished studies up to May 2017. In total, 2393 abstracts were assessed for eligibility, 216 full-text articles were reviewed, and 45 samples (with 31,225 participants) provided estimates of effect sizes.

RESULTS

The mean prevalence of child sexual abuse disclosure in forensic settings was 64.1% (95% CI: 60.0-68.1). Between-study variability was explained by: (1) child age and gender, with higher prevalence in older children and females; (2) prior disclosure, with higher prevalence when present; and (3) study year, with higher prevalence in more recent studies.

CONCLUSIONS

This meta-analysis confirms an upward trend in child sexual abuse disclosure prevalence. However, more than a third of children do not disclose when interviewed, with those who are younger, male, and without a prior disclosure at greatest risk. Important implications for forensic interviewing protocols and future research are discussed.

Credibility Judgment Predictors for Child Sexual Abuse Reports in Forensic Psychiatric Evaluations

OBJECTIVE

We intended to analyze the credibility judgment in written forensic psychiatric reports of child sexual abuse registered in Southern Taiwan.

METHODS

Ninety-six cases of child sexual abuse between August 2010 and October 2017 encountered in two hospitals were analyzed. The.

RESULTS

in these reports were categorized into credible and non-credible. We identified the factors that distinguished between the two groups in bivariate analyses using chi-square test. A binary logistic regression analysis was performed to determine whether the factors that significantly correlated in the bivariate analyses were independent predictors of credible judgments.

RESULTS

Among 96 cases, 70 (73%) were judged as credible. Consistent testimonies of children (odds ratio=40.82) and multiple abuse events (odds ratio=6.05) were positive variables independently related to the sexual abuse allegations judged as credible.

CONCLUSION

The number of allegations judged as credible in this study was slightly higher than that reported in other studies. Our findings about predictors for credible cases are not in line with those reported previously. Due to the differences in resources of the cases and backgrounds of the evaluators among multiple studies, direct comparisons with previous studies must be treated with caution.

When Is a Child's Forensic Statement Deemed Credible? A Comparison of Physical and Sexual Abuse Cases

A large national sample of 4,775 reports of child physical and sexual abuse made in Israel in 2014 was analyzed in order to examine whether assessments of credibility would vary according to abuse type, physical or sexual, and whether child and event characteristics contributing to the probability that reports of abuse would be determined as credible would be similar or different in child physical abuse (CPA) and child sexual abuse (CSA) cases. Results revealed that CPA reports were less likely to be viewed as credible (41.9%) compared to CSA reports (56.7%). Multigroup path analysis, however, indicated equivalence in predicting factors. In a unified model for both types of abuse, salient predictors of a credible judgment were older age, lack of a cognitive delay, and the alleged abusive event being a onetime less severe act. Over and beyond the effects of these factors, abuse type significantly contributed to the prediction of credibility judgments.
